Agreement to Terms

Welcome to Harvesters Kingdom Training Centre ("Institution," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, educational programs, student portal, staff portal, and all related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

Important: Please read these Terms carefully before using our Services. These Terms include important information about your rights and obligations, including mandatory arbitration and class action waiver provisions.

1 Eligibility and Registration

Age Requirements

To register for our programs, you must:

  • Be at least 16 years of age, or
  • Have a parent or legal guardian complete the registration on your behalf if under 16
  • Provide accurate and complete information during registration
  • Meet the minimum academic qualifications for your chosen program

Registration Process

  1. 1 Submit a complete application with all required documents
  2. 2 Receive admission letter upon approval
  3. 3 Pay registration and initial fees
  4. 4 Create student portal account
  5. 5 Attend orientation and begin classes

Verification: We reserve the right to verify the information you provide and may request additional documentation. Providing false information may result in application rejection or expulsion.

2 Account Security

Your Responsibilities

Maintain Confidentiality

Keep your username and password confidential. Do not share your login credentials with anyone.

Secure Your Account

Use a strong password with at least 8 characters, including uppercase, lowercase, numbers, and symbols.

Report Unauthorized Access

Notify us immediately if you suspect unauthorized access to your account or any security breach.

Liability for Account Activity

You are responsible for all activities that occur under your account, including any unauthorized use.

3 Admission and Enrollment

Admission Process

Admission to our programs is competitive and selective. We consider:

  • Academic qualifications and certificates
  • Application completeness and accuracy
  • Available space in the program
  • Meeting program-specific requirements
  • Interview performance (where applicable)

Enrollment Confirmation

Your enrollment is confirmed when you:

Sign and return admission letter

Complete fee payment as specified

✓ Submit Documents

Provide all required certificates

✓ Attend Orientation

Participate in mandatory orientation

Important: Admission offers are valid for the specified intake only. Failure to enroll by the deadline will result in cancellation of your admission. We do not guarantee re-admission in future intakes.

4 Fees and Payment Terms

Fee Structure

All students are required to pay the following fees:

  • Registration Fee: One-time non-refundable fee (payable at admission)
  • Tuition Fees: Per term/semester as specified in fee structure
  • Examination Fees: KNEC/CDACC assessment fees (where applicable)
  • Activity Fees: Student activities, sports, and events
  • Material Fees: Training materials and equipment (program-specific)

Payment Terms

Payment Deadlines

Fees must be paid by the deadlines specified in your fee invoice. Late payment may result in penalties or suspension of services.

Payment Methods

We accept M-PESA, bank transfers, and cash payments. All payments must include your student ID for proper allocation.

Payment Plans

Installment payment plans are available upon request. Contact the finance office to arrange a payment schedule.

Refund Policy

  • Registration fees are non-refundable under any circumstances
  • Tuition refunds are prorated based on withdrawal date (before 25% of term = 75% refund; before 50% = 50% refund; after 50% = no refund)
  • Examination fees are non-refundable once submitted to KNEC/CDACC
  • • Refund requests must be submitted in writing within 30 days
  • • Processing takes 30-60 business days

5 Academic Standards and Expectations

Attendance Requirements

Minimum Attendance: 80% of scheduled classes

  • • Attendance is monitored electronically via student portal check-in
  • • Students below 75% attendance will receive a warning
  • • Students below 70% attendance may be barred from examinations
  • • Repeated absences without valid reasons may result in dismissal

Academic Performance

Competent Performance

  • • Meet all competency requirements
  • • Submit assignments on time
  • • Pass practical assessments
  • • Complete portfolio evidence

Not Yet Competent (NYC)

  • • Opportunity for reassessment
  • • Remedial training provided
  • • Maximum 3 reassessment attempts
  • • May need to repeat module

Certification Requirements

To receive your TVET certificate, you must:

  1. Complete all required modules and competencies
  2. Achieve "Competent" status in all assessments
  3. Complete industrial attachment (where applicable)
  4. Clear all fee balances
  5. Pass KNEC national examinations (for national certificate programs)
  6. Return all borrowed materials and equipment

6 Code of Conduct

All students, staff, and visitors must adhere to our code of conduct:

Treat everyone with dignity and respect

Professional Conduct

Maintain professional demeanor at all times

Academic Honesty

No plagiarism, cheating, or falsification

Property Respect

Care for institution property and equipment

Prohibited Conduct

The following behaviors are strictly prohibited:

  • • Violence, threats, harassment, or discrimination of any kind
  • • Possession or use of drugs, alcohol, or weapons on campus
  • • Theft, vandalism, or destruction of property
  • • Academic dishonesty (plagiarism, cheating, falsification)
  • • Unauthorized access to systems or confidential information
  • • Disruption of classes or institutional activities
  • • Inappropriate dress or conduct contrary to institutional values

Disciplinary Action: Violations may result in warnings, suspension, or expulsion depending on severity. Serious offenses will be reported to law enforcement.

7 Intellectual Property Rights

Our Content

All content on our website and learning materials, including text, graphics, logos, images, videos, and software, is the property of Harvesters Kingdom Training Centre or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Your Use Rights

✓ You may: Print or download content for classroom use

✗ You may not: Reproduce, distribute, or sell our materials

✗ You may not: Remove copyright notices or trademarks

Student Work

You retain ownership of original work you create. However, you grant us a non-exclusive license to:

  • Display your work in portfolios and promotional materials (with attribution)
  • Use your work as examples for future students
  • Share your success stories and testimonials

8 Website Use and Restrictions

Acceptable Use

When using our website and online services, you agree to:

  • Use services only for lawful purposes
  • Provide accurate and current information
  • Maintain the security of your account
  • Respect the rights and privacy of others
  • Comply with all applicable laws and regulations

Prohibited Activities

You must not:

We do not guarantee that:

  • Our services will meet your specific requirements

10 Limitation of Liability

Important legal information

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HARVESTERS KINGDOM TRAINING CENTRE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • • LOSS OF PROFITS, REVENUE, DATA, OR USE
  • • LOSS OF OR DAMAGE TO PROPERTY
  • • PERSONAL INJURY OR EMOTIONAL DISTRESS
  • • CLAIMS OF THIRD PARTIES

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Maximum Liability: In no event shall our total liability to you exceed the amount of fees you paid to us in the six (6) months prior to the event giving rise to the liability.

11 Termination

By You

You may terminate your enrollment by submitting a written withdrawal notice to the Registrar's Office. Refunds, if any, will be processed according to our refund policy (Section 4).

By Us

We may suspend or terminate your access to our services immediately, without notice, if you:

  • Violate these Terms of Service
  • Fail to pay required fees
  • Engage in prohibited conduct
  • Provide false or misleading information
  • Fail to meet academic or attendance requirements

Effect of Termination

Upon termination:

  • • Your access to services will be revoked
  • • Outstanding fees remain due and payable
  • • You must return all borrowed materials
  • • Sections that survive termination remain in effect (IP rights, disclaimers, liability limitations)

12 Governing Law and Dispute Resolution

Applicable Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

Dispute Resolution

Step 1: Informal Resolution

Contact us first to resolve disputes informally through good faith negotiation.

Step 2: Mediation

If informal resolution fails, disputes will be submitted to mediation.

Step 3: Arbitration or Court

Unresolved disputes may be submitted to arbitration or to the courts of Nairobi, Kenya.

13 Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the "Effective Date" at the top of this page
  • We will notify you via email or website announcement for material changes
  • Changes become effective immediately upon posting
  • Your continued use constitutes acceptance of the modified Terms

Your Responsibility: Please review these Terms periodically. If you do not agree to modified Terms, you must discontinue use of our Services.
